JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Imamganj P.S. Case No. 87 of 2012 registered under Sections 304(B), 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of killing of the daughter of the informant by her husband and in-laws due to non fulfillment of demand of dowry and her dead body was disposed of. Admittedly, the petitioner is the husband of the daughter of the informant and earlier prayer of anticipatory bail of the petitioner was rejected vide order dated 22.05.2014 passed in Criminal Misc. No. 6990 of 2014 whereas in-laws of the deceased were allowed the privilege of anticipatory bail.

Patna High Court Cr.Misc. No.46223 of 2014 (3) dt.07-05-2015 Having considered the facts and circumstances of the case, I am not inclined to reconsider the prayer of anticipatory bail of the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
