JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148,149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
The informant has alleged that these petitioners and other co-accused ,due to some dispute, assaulted and caused injuries to the informant, his father and brother and snatched a chain of gold from the neck of his mother.
It has been submitted on behalf of the petitioners that it is a case and counter case. Further it has been submitted that the injuries caused to the informant side are simple in nature. Further it has been submitted that the injuries which were sustained by the
Patna High Court Cr.Misc. No.25861 of 2015 (2) dt.16-07-2015 2/2 accused persons have not been explained by the prosecution, which cast serious doubt upon the prosecution case. On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K.Sinha, Judicial Magistrate, 1st Class, Araria in connection with Palasi P.S.Case No. 45 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
