The petitioner apprehends his arrest in connection with Motipur P.S. Case No.8 of 2021 registered under Sections 272 and 273 of the I.P.C. and Sections 30(a), 41(1)(2) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that similarly situated co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 09.12.2022 passed in Cr.Misc.No.66498 of 2022. He also submits that the petitioner has got no criminal antecedent. Having considered the fact that similarly situated coaccused has been granted bail by a coordinate Bench of this Court, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.56781 of 2022(3) dt.02-01-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court II, Muzaffarpur in connection with Motipur P.S. Case No.08 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
