2. The petitioner seeks regular bail in connection with Sugauli P.S. Case No. 267 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.

3. On getting secret information, police party intercepted a motorcycle and arrested a person who disclosed his name as petitioner. On search, 40 litre country made liquor kept in a plastic sack tied with the motorcycle was recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He had no knowledge about the seized liquor on the motorcycle which was given to him to deliver other person. He has no concern with the seized liquor. There is no compliance of

Petitioner has one criminal antecedent which does not belong to Excise Act. He is in custody since 23.05.2025. It is submitted that similarly situated co-accused, namely, Om Prakash Chaudhary has been granted bail by a Co-ordinate Bench of this Court, vide order dated 13.08.2025 passed in Cr. Misc. No. 54593 of 2025.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran in connection with Sugauli P.S.
