The petitioners seek bail in Rosera P.S. Case No. 131 of 2019, instituted for the offence under Section(s) 302 and 307/34 of Indian Penal Code.

Counsel for the petitioner submits that there is no specific allegation of assault against the petitioner. The specific allegation of assault on the husband of the informant is against co-accused Md. Rajjak. Petitioners are wife and son of Md. Rajjak. He further submits that co-accused Md. Jalil with similar allegation has already been granted bail by coordinate Bench of this Court vide order dated 29.8.2019 passed in Cr.

Patna High Court CR. MISC. No.54532 of 2019(2) dt.03-09-2019 2/2 Misc. 53223 of 2019.

Petitioners are in custody since 13.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Rosera, Samastipur, in connection with in Rosera P.S. Case No. 131 of 2019, subject to the condition that both the bailors will be close relatives of the petitioners.
