JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 436 and 427 of the Indian Penal Code.
The accusation is of litting fire in the house of the informant as a result articles worth `2,00,000/- got burnt. It is submitted by learned counsel for the petitioners that admittedly the informant is not the eye-witness to the occurrence and the wife and son of the informant came to the place of occurrence after seeing smoke, hence only on suspicion, the accusation has been levelled in the background of land dispute. Moreover, for the occurrence of 25.11.2011, the FIR was registered on 11.12.2011.
Patna High Court Cr.Misc. No.25521 of 2015 (2) dt.01-07-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Minapur P.S. Case No. 336 of 2011 pending in the court of learned CJM, Muzaffarpur. Accordingly, the application is disposed of.
