Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 06-01-2020 By order dated 20.11.2019 this Court confirmed the provisional bail granted to the petitioner nos. 2 and 3 by order dated 27.08.2019.

2. Learned counsel for the petitioners points out that anticipatory bail granted to the petitioner no. 1 has inadvertently been missed to be included in the order dated 20.11.2019. The submission of learned counsel for the petitioners is found to be correct.

3. Accordingly, the order dated 20.11.2019 be read by incorporating para 5 therein as follows -- "5. As regards petitioner no. 1, Ajay Chaudhary, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, let the petitioner no. 1, Ajay Chaudhary, be released on bail on furnishing bail bond of Rs.10,000/-

Patna High Court CR. MISC. No.53842 of 2019(5) dt.06-01-2020 2/2 (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Sitamarhi, in connection with Riga P.S. Case No. 83 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C. and also subject to the following further conditions: i. That one of the bailors shall be a close relative of the petitioner no. 1.

ii. That the petitioner no. 1 shall not indulge in any similar offence till conclusion of the trial. iii. That the petitioner no. 1 shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.

iv. The petitioner no. 1 shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned."
