JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Khaira P.S. Case No. 257 of 2014, registered under Sections 147, 148, 323, 325, 379, 384, 307 and 504 of the Indian Penal Code and Section 3(I)(X) of the SC/ST Act.

The accusation is that six accused persons named in the F.I.R., including the petitioner, made demand of ransom of Rs. 20,000/- to the informant Prem Paswan and also started to abuse him and caused assault, at that time they snatched Rs. 20,500/- from his pocket and this petitioner gave sword blow at his head.

No.2791 of 2016 (3) dt.17-03-2016 2/2 petitioner submits that, in fact, out of six persons, four are the sons of the petitioner and one is brother and due to hot talk exchanged in between the son of the petitioner and informant he lodged this case implicating the petitioner showing the allegation of causing injury by sword. Further submission is that petitioner is aged about 75 years and he is in custody since 15.12.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Umesh Kumar Pandey, Judicial Magistrate, 1st Class, Jamui in connection with Khaira P.S. Case No. 257 of 2014.
