JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Town P.S. Case No. 810 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 38(2) of the Bihar Excise (Amendment) Act, 2016. The allegation is regarding recovery of 9 liters of foreign liquor from three persons travelling on a motorcycle after they were apprehended by the Police.
The learned counsel for the petitioner submits that no recovery has been made from the conscious possession of the petitioner and he has been falsely implicated in the present case as well as he is languishing in custody since 04.11.2017.
Patna High Court Cr.Misc. No.61658 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation levelled against the petitioner as also the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Town P.S. Case No. 810 of 2017.
