JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,379,307,504 and 506/34 of the Indian Penal Code. The prosecution case is that the accused persons came variously armed and started abusing when petitioner nos. 1 and 2 assaulted the informant Sajjad and his brother Saddam by farsa. The other acused persons assaulted the parents of the informant. It is alleged that petitioner no. 4 Doctor Ansari committed theft of a box containing cash of rupees two lacs, clothes and ornaments. Co accused Megiya Khatoon also committed theft of gold chain of the
Patna High Court Cr.Misc. No.2620 of 2016 (2) dt.18-01-2016 2/2 informant's mother.
It is submitted by the learned counsel for the petitioners that the injuries of the informant side have been found to be simple. The case lodged by the petitioners side is at earlier point of time and due to land dispute the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Paharpur P.S. Case No. 144 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
