2. The petitioner apprehends his arrest in a case registered for the offence under Sections 20(b)(ii)(B) and 29 of N.D.P.S. Act.
3. As per the F.I.R., 475 grams of Charas was recovered from the house of Bhola Sah leading to F.I.R. against unknown. After investigation, police submitted final form. Differing with the same, cognizance was taken against the petitioner.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence. No narcotic substance has been recovered from the house of the petitioner. Recovery has been made from the house of Bhola
Patna High Court CR. MISC. No.61865 of 2025(2) dt.09-09-2025 2/2 Sah. Alleged recovery is less than commercial quantity. Petitioner has no antecedent of similar nature.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, NDPS, Bettiah, West Champaran, in connection with Majhauliya P.S. Case No. 454 of 2020 , subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
