JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 26.11.2015 in a case registered for the offences punishable under Sections 20, 21, 22 and 25 of the NDPS Act.

Three green plants of ganja were recovered from the courtyard of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is the casual resident of native place and the straw plants were grew in the courtyard of the petitioner and no weight of plant has been assessed by the prosecuting agency. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/-

Patna High Court Cr.Misc. No.3303 of 2016 (2) dt.20-01-2016 2/2 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger in connection with Kharagpur P.S. Case No. 259 of 2015.
