JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Ratanpura PS case no. 47 of 2017 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of illicit liquor from the possession of the petitioners. The learned counsel for the petitioners submits that nothing has been recovered from the conscious possession of the petitioners, they have clean antecedents and they are in custody since 31.10.2017.

Considering the nature of accusation, clean

Patna High Court Cr.Misc. No.60219 of 2017 (2) dt.21-12-2017 2/2 antecedent and the period of custody undergone, this Court is inclined to grant bail to the petitioners. Accordingly, the petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs.
