Petitioner is named in the first information report but according to prosecution case itself, it were other accused, who opened fire on the informant.

Submission on behalf of the petitioner is that one Manish Singh of Harauli village was involved in the present case but police implicated the petitioner in the present case and when the aforesaid fact came to the notice of the informant, he filed protest petition before the court below, which is evident from perusal of Annexure-2 to this petition.

Petitioner carries criminal antecedent of some cases but taking note of the aforesaid facts and circumstances as well as

Case No. 08 of 2015 to the satisfaction of Sri Sushant Ranjan, learned Judicial Magistrate-Ist Class, Patna City.
