The petitioner Md. Umar seeks bail in Matihani P.S. Case No. 62 of 2013, registered for the offences punishable under Sections 147, 148,149,302, 120(B) of the Indian Penal Code and also under Section 27 of the Arms Act.

Md. Imtiyaz named the petitioner along with other accused persons and alleged that they were standing outside the gate of Mosque. Md. Kasim, Md. Masi Alam and Md. Jamahir fired on his own brother Md. Umar.

Learned Counsel for the petitioner submits that there is no allegation of firing against Md. Umar the petitioner. On perusal of record it appears that the petitioner is of course named in the First Information Report, but there is no

Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Judicial Magistrate, Ist Class, Begusarai in connection with Matihani P.S.
