Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 313, 323, 341, 379, 504/34 of the Indian Penal Code. It is alleged against the petitioner that he assaulted the complainant on her abdomen with legs and pressed the abdomen by his ankle as a result of which the pregnancy of the complainant got terminated.

It is submitted by learned counsel for the petitioner that petitioner is agnate of the complainant and in the background of land dispute the accusation has been levelled. Moreover the complainant got her medical examination done from a private doctor in Hajipur town after travelling 35 Km from the place of occurrence but no medical examination was done at any government hospital or Primary Health Centre

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 809 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur.

With the observations above, the application stands disposed off.
