The petitioner seeks bail in Nokha P.S. Case No. 210 of 2016 registered under Sections 8(c), 20(B), 22, 27(A) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. The prayer of the petitioner was earlier rejected vide order, dated 19.04.2017, passed in Cr. Misc. No. 8633 of 2017. The police intercepted a vehicle and apprehended two persons, namely, Kundan Kumar and Sanjay Kumar, the petitioner, and one Govind Kumar is said to have fled away. Kundan Kumar was the driver of the vehicle. The petitioner is said to be a passenger. It appears that eight packets, each containing two kilogram, i.e., 16 Kg, ganja were recovered from vehicle and for that the petitioner is in jail since31.08.2016 for recovery of 16 Kg of ganja from the joint possession of the petitioner and the driver of the vehicle. The petitioner has also remained in jail for about fifteen months. Kundan Kumar, the driver of the vehicle has already been enlarged on bail. Considering the entire facts, aforesaid, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.54924 of 2017 (3) dt.06-12-2017 2/2 bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nokha P.S. Case No. 210 of 2016 to the satisfaction of the Special Judge, Rohtas at Sararam.
