JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 It is submitted that petitioner no.1 has been arrested, hence, application with regard to petitioner no.1 has become infructuous.

Accordingly, the same is disposed of.

Petitioner nos. 2 to 6 are apprehending arrest in a case registered for the offences punishable under Sections 323, 324, 341, 504, 379 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the accused persons variously armed surrounded the informant and snatched the motorcycle of the

No.25555 of 2015 (2) dt.01-07-2015 2/2 informant when on the order of Harendra Manjhi, petitioner no.2 assaulted with farsa to the informant causing cut injury on the head whereas petitioner no.3 assaulted with lathi on the back of the informant. Petitioner no.1 and co-accused Ram Rup Rai snatched the chain from the wife of the informant and thereafter Bindeshwari Rai snatched the earring. It is also alleged that petitioner no.6 resorted to fire.

It is submitted by learned counsel for the petitioners that maliciously the accusation has been levelled and there is nothing on record to suggest that the informant has received any serious injury.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Adapur P.S. Case No. 188 of 2013 pending in the court of learned SDJM, Raxaul, Motihari. Accordingly, the application is disposed of.
