JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2017 In view of the fact that earlier also prayer for bail of the appellant has been rejected by this Court in Cr.Appeal(SJ) No. 1746 of 2017, vide order dated 25.8.2017 with an observation to renew his prayer for bail after framing of charge, it is submitted that now charge has been framed in this case and appellant is in custody for eight months and he is ready to abide by any condition that may be imposed on him.

Heard learned Special P.P.

In view of the facts and circumstances, the appeal is allowed and the impugned order dated 13.11.2017 passed by 1st Additional Sessions Judge-cum-Special Judge, Araria is set aside. Let appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand)

(1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and (2) appellant shall co-operate in trial and appear on each and every date, failing which his bail bond shall be cancelled. (Vinod Kumar Sinha, J) spal/- U
