Petitioner, already in custody, seeks bail in connection with Sare P.S. Case No.130 of 2017, registered under Sections 414 and 401 of the Indian Penal Code.

Allegation in brief is that the police on secret information raided and caught two persons indulged in committing theft of motorcycle and recovered one stolen motorcycle and one of the accused in his confessional statement named the petitioner acknowledging that he has sold one stolen motorcycle to the petitioner and later on the said motorcycle was recovered from the house of the petitioner.

Learned counsel for the petitioner submits that it is not the allegation that the petitioner is the member of the gang of

No.60949 of 2017 (2) dt.19-12-2017 2 /2 thieves indulged in stealing motorcycle, the only allegation is that, as per confessional statement of one of the co-accused, stolen motorcycle was sold to this petitioner, the petitioner has no criminal antecedent and has been in custody since 03.10.2017. Having considered the said facts and circumstances, let petitioner, Binod Bind, be directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Nalanda in connection with Sare P.S. Case No.130 of 2017.
