2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 115 ( 2 ), 118 ( 2 ), 109 (1) , 352 and 3 (5) of the BNS. 3 . As per F.I.R., informant namely Sushma Devi alleged that on 25.03.2025 , petitioner No. 1 caught hold of informant and other co-accused persons including petitioner No. 2 assaulted informant with lathi due to which she sustained injury .
4. Learned counsel for the petitioners submit that allegation of assault is general and omnibus against petitioner
Patna High Court CR. MISC. No.57422 of 2025(2) dt.02-09-2025 2/2 No. 2 and there is absolutely no allegation of overt act against petitioner No. 1 . Doctor has found the injury simple in nature . 5 . Learned counsel for the State oppose the bail petition .
6. Considering the nature of injury and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM Barh District Patna in connection with Belchi P.S. Case No. 62 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
