The petitioner is apprehending his arrest in connection with Singhwara P.S.Case No.70 of 2019 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecutions story is that the police has found the petitioner and other accused persons in front of the house of his house and seeing the police party they fled away . From there total 4.125 ml. Of liquor has been recovered. Submission of the learned counsel for the petitioner is that the petitioner has enmity with the informer of the police as such he along with his brother has falsely been implicated in this case.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ II cum Special Judge (Excise Act) Darbhanga in connection with Singhwara P.S.Case No.70 of2019 to G.O. No.511 of 2019 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
