The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 324/307/349 of the Indian Penal Code and 27 of the Arms Act. Prosecution case is that while the police was chasing three miscreants, the informant assisted the police in chase when the accused persons resorted to fire causing injuries to the informant. The police and the villagers suggested the name of the miscreants as Mahboob, Alam and the petitioner. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. Considering the fact that the case was registered in 2012 and the petitioner was named in the FIR, this Court is not
Patna High Court Cr.Misc. No.3016 of 2016 (2) dt.19-01-2016 2/2 inclined to grant anticipatory bail to the petitioner. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Baisi P.S. Case No.222/2012, pending before the learned Judicial Magistrate, 1st Class, Purnea.
With the above observation, this application is, accordingly, disposed off.
