The petitioner seeks bail in connection with Lalganj P.S. Case No. 62 of 2017 dated 28.03.2017 instituted for the offences under Sections 302, 120(B) and 34 of the Indian Penal Code.
The petitioner is the wife of the deceased. The FIR has been lodged by the father of the deceased who has alleged that the relationship between the deceased and his wife i.e. the petitioner was not cordial. Threatening also was given to the family of the informant in the past. The deceased was staying in his father-in-law's house for sometime. On the day of the occurrence, the informant (father of the deceased) was telephonically informed that his son is not well. When he came to
Patna High Court Cr.Misc. No.56612 of 2017 (2) dt.30-11-2017 the Sasural of his son, he found his son dead. The post-mortem report reveals that death was caused by strangulation. There is no eye witness to the occurrence.
Mr. Bakshi, learned Senior Advocate has argued that despite the fact being that the deceased died in the house of the petitioner's father, the case remains in the realm of suspicion. The father and brother of the petitioner who are the father-in-law and brother-in-law of the deceased have been granted bail by a Bench of this Court vide order dated 12.09.2017 in Cr. Misc. No. 42146 of 2017.
Regard being had to the fact that the petitioner is a lady and is in custody since 29.03.2017 and other circumstances stated above, this Court is inclined to grant bail to her. In the facts and circumstances, the petitioner above named is directed to be released on bail on her furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 62 of 2017.
