The petitioner apprehends his arrest in Bihiyan P.S. Case No.152 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant got information that the petitioner and Ajmer Khan were selling liquor. On such, a raid was conducted and 23 litres of country made liquor was recovered from a bush situated in a lonely place.

Learned counsel for the petitioner submits that the informant did not disclose the name of person from whom the informant came to know about the name of the petitioner. The petitioner has got no criminal antecedent and he has falsely been implicated in the case.

Having considered the facts that the recovery was

No.53645 of 2019(2) dt.27-08-2019 2/2 made from a bush situated in a lonely place and the name of the petitioner transpired in the disclosure made by spy of the police, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. IV-cumSpecial Judge, Bhojpur at Ara in connection with Bihiyan P.S. Case No.152 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
