JUSTICE MADHURESH PRASAD ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for offence under sections 25(1-B) a/26/35 of the Arms Act on the allegation of recovery of a country made pistol from him in course of random check.

Counsel for the petitioner submits that the petitioner has no antecedent and is in custody since 16.8.2017. Investigation has been completed and the charge sheet has also been submitted in this case. Co-accused Shashi Shekhar Dubey from whose possession a cartridge was recovered has already been allowed bail by the court below itself.

In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl Chief Judicial Magistrate XI, Saran at Chapra in Beniapur Police Station Case No. 221 of 2017 on the following conditions:-

No.60236 of 2017 (2) dt.20-12-2017 (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
