The petitioner, who is in custody, seeks bail in connection with Mokama R.P.F. P.S. Case No. 4 of 2017 registered for the offence punishable under Section 3 R.P.U.P. Act 1966 (Amendment Act).

Informant is A.S.I., R.P.F. Post Mokama in his complaint has stated that on 30.07.2017 at about 1.30 pm he was on patrolling duty he received information that four plastic bags, 30 kg each having railways marks which have been kept in nearby field after committing theft. Informant reached that place and seized the articles and FIR was registered against unknown. Name of the petitioner has surfaced in this case on the basis of confessional statement made by one co-accused and except that

Patna High Court Cr.Misc. No.461 of 2018 (2) dt.18-01-2018 2/2 confessional statement there is no incriminating material against the petitioner. It has been submitted that petitioner has no criminal antecedent and he is in custody since 24.08.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway Patna, in connection with R.P.F. Post Mokama P.S. Case No. 4 of 2017.
