JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mohania Police Station Case No. 132 of 2015 registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.

Petitioner happens to be rice mill owner and the accusation against him is that he did not supply rice and defalcated huge government money.

The contention on behalf of the petitioner is that in several cases different Benches of this Court have already granted the privilege of anticipatory bail to several persons and moreover,

Patna High Court Cr.Misc. No.26175 of 2015 (2) dt.16-07-2015 2/2 the present case appears to be violation of agreement for which the State Food Corporation may initiate a certificate case. Considering the aforesaid facts and circumstances as well as this aspect of the matter that several Benches have already granted anticipatory bail to several persons, let in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Mohania Police Station Case No. 132 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
