JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-08-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 446 arising out of Chausa P.S. Case No. 158 of 2019 for the offenses under Sections 392 and 414 of the Indian Penal Code.

Allegation against the petitioner is that he was involved in loot of maize grain. 177 packets of maize grain is alleged to have been recovered.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 7.6.2019.

Considering the totality of the fact situation, the Court is inclined to grant bail to the petitioner on payment of Rs.

Patna High Court CR. MISC. No.52727 of 2019(2) dt.30-08-2019 2/2 50,000/- cash in the court below. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge III, Madhepura in connection with Sessions Trial No. 446 arising out of Chausa P.S. Case No. 158 of 2019, subject to deposit of Rs. 50,000/- in cash in the court below. The deposit of Rs. 50,000/- cash shall abide by the final outcome of the pending criminal case.
