Petitioner, already in custody, seeks bail in connection with Harsidhi P.S. Case No.292 of 2016, registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation is that on exhortation of the petitioner, another co-accused Rakesh Singh fired upon the informant. Learned counsel for the petitioner submits that the petitioner is only alleged to be an order giver and no other overt act is alleged, even there is no firearm injury on the person of the informant rather one incised wound over the left upper arm simple in nature caused by sharp object and the petitioner is in custody

Patna High Court Cr.Misc. No.61175 of 2017 (2) dt.19-12-2017 2 /2 since 18.10.2017.

Having considered the said facts and circumstances, let petitioner, Hari Shankar Singh, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Harsidhi P.S.
