The petitioner seeks bail in connection with Sarsi P.S. Case No. 38 of 2017 dated 14.04.2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 379, 387, 354(B), 307, 504 and 506 of the Indian Penal Code. The petitioner is said to be a member of the unlawful assembly which has gathered on the field of the sister of the informant. The sister of the informant was disrobed and the father of the informant was subjected to assault, leading to simple and grievous injuries on his person.
Learned counsel for the petitioner, on the strength of the averments made in the FIR, has stated that the allegations are general and omnibus and no specific act has been attributed to the
Patna High Court Cr.Misc. No.53995 of 2017 (3) dt.27-11-2017 petitioner. He has further submitted that one of the co-accused Punit Kumar Mahto has been granted bail by the court below; whereas two of the accused persons namely Bhusan Prasad Mahto and Nunu Lal Mahto have been granted bail by the court below. The petitioner is in custody since 14.09.2017 and does not bear any criminal antecedent.
In the facts and circumstances, the petitioner above named is directed to be released on bail on furnishing his bail bond of a sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea in connection with Sarsi P.S. Case No. 38 of 2017.
