JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Maner PS case no. 177 of 2017 instituted for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 1260 litres of foreign liquor from the petitioner.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case, he has clean antecedent and he is in custody since 25.09.2017. It has been further submitted that the co-accused person has been granted bail by this Court by an order dated 07.07.2017 passed in Criminal

Patna High Court Cr.Misc. No.60177 of 2017 (2) dt.21-12-2017 2/2 Miscellaneous no. 30578 of 2017.

Considering the nature of accusation, clean antecedent, the fact that the co-accused has been granted bail and the period of custody undergone, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise, Patna in connection with Maner PS case no. 177 of 2017.
