====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 23-11-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 30 (a)/36 of Bihar Excise Amendment Act.

It is contended that, as per allegation, the petitioner, who claims to be the driver of the Tempo, after seeing the police party, tried to escape, however, he was apprehended. Thereafter, the Tempo was searched and about 90 liters of country made liquor was recovered. It is contended that nothing was recovered from the physical possession of the petitioner and he does not have any connection with regard to the alleged recovered items. It is urged that the petitioner has remained in custody since 13.08.2017,i.e., more than three months. It is claimed that his antecedent is clean.

Patna High Court Cr.Misc. No.54178 of 2017(2) dt.23-11-2017 2/2 Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 98 of 2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
