The Petitioner is apprehending his arrest in a case registered for the offences punishable u/s 147, 148, 341, 323, 353, 307, 354A, 188, 337, 338, 504 and 506 of the Indian Penal Code.
As per the prosecution case, the petitioner and the coaccused persons were standing at the ghat where the labourers were unloading sand from the boat. On seeing the police party

In the meantime, the FIR named persons called their associates which is 50 to 60 in numbers and started throwing bricks and stones on the police party with intent to kill, due to which the police personnel became injured and they also misbehaved with the lady constables.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. He has submitted that there is general and omnibus allegation against the petitioner. He has further submitted that the petitioner was not present at the time of occurrence. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 423 of 2021, subject to conditions as laid down under section
Patna High Court CR. MISC. No.55551 of 2022(2) dt.23-01-2023 3/3 438(2) of the Code of Criminal Procedure.
