JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 341, 323, 307, 504, 384 of the Indian Penal Code.

As per FIR when the construction wok was going on a plot no. 3263, area 5 decimals, all accused persons came to the site of the informant, threatened to stop the construction and demanded extortion money of Rs. 5 lacs, failing which assault took place as a result of which Sonjharia Devi and Ram Di Mahto sustained injury.

It has been submitted on behalf of the petitioners that

Patna High Court Cr.Misc. No.26409 of 2015 (2) dt.22-07-2015 2/2 there is Title Suit No.194 of 2014 pending between the parties. It has been submitted that the petitioners have got no criminal antecedent. It is also submitted that other co-accused has been granted anticipatory bail , vide Cr. Misc. No.24422 of 2015. On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Bihta P.S.case No. 893 of 2014,G.R.No. 4237 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
