Petitioner apprehends his arrest in Sitamarhi P.S. Case No.249 of 2019, registered under Sections 307, 379 and other minor sections of the Indian Penal Code.

The informant alleged that while he was returning from the medical shop after purchasing medicine and reached near the cremation ground, Rama and Randhir Ram caught the petitioner and abused. Petitioner, Randhir Ram caught the informant and on such Rama pierced knife in the neck of the informant and petitioner also snatched Rs.2000/- from the pocket of the informant.

Learned counsel for the petitioner submits that there is no allegation of assault against the petitioner. The allegation of snatching money is ornamental but it appears that the petitioner

Patna High Court CR. MISC. No.51772 of 2019(2) dt.20-08-2019 2/2 and his accomplice finding the informant in a lonely place caught him and on such Rama pierced knife in the neck of the informant and the petitioner snatched money from possession of the informant.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
