JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kalyanpur PS Case No. 41 of 1994 (Sessions Trial No. 316 of 1995) registered under Sections 147, 148, 149, 323, 324 and 307 of the IPC. It is long misuse of the privilege of bail for more than a decade and the case is of the year 1994 and due to absence of the petitioner charge could not be framed and the case was fixed for charge on 18.10.2017.

So the prayer for bail of the petitioner is refused at this stage. The trial court is directed to expedite the trial and conclude the same preferably within six months. If the same is not concluded the petitioner may renew the prayer.
