2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
3. As per prosecution case, it is alleged that four unknown miscreants, armed with pistol, intercepted the informant and looted his bag containing cash Rs. 64,675/-, ATM card and other documents.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R..
Patna High Court CR. MISC. No.57407 of 2025(2) dt.27-08-2025 2/3 Name of petitioner transpired in this case during course of investigation on the basis of confessional statement of coaccused person. Except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged occurrence. No looted article has been recovered from conscious possession of the petitioner. It is further submitted that similarly situated co-accused person, namely Amit Kumar Sah, has already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 12.02.2025 passed in Cr. Misc. No. 1812 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and claim based on parity, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Ist Class, Saran at Chapra in connection with Baniyapur P.S. Case No. 270 of
Patna High Court CR. MISC. No.57407 of 2025(2) dt.27-08-2025 3/3 2022, subject to condition as laid down under Section 482(2) of the B.N.S.S..
