Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 341, 448, 342, 354(A)(1)(B), 323, 504, 376/511, 379, 34 of the Indian Penal Code.
It is alleged against the petitioner that he entered into the room and tried to ravish the informant by dragging her.
It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and Title Suit No. 126 of 2013 is pending between the parties. It is further submitted that for the occurrence of 28.04.2013 the First Information Report was registered on 07.06.2013 and for the same incidence Complaint Case No. 1573 of 2013 was also filed by the informant. During investigation the accusation was
Patna High Court Cr.Misc. No.27728 of 2015 (2) dt.27-07-2015 2/2 found false and final form was submitted but differing with the final form, cognizance has been taken.
Considering the accusation levelled in the background of pending title suit, petitioner being agnate, delayed lodging of the case and the investigation being concluded, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 173 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
