The petitioner is accused in Patori Police Station Case No 177 of 2017 registered for the offences punishable under Sections 304B/34 of Indian Penal Code.

Counsel for the petitioner submits that being fatherin-law of victim, the petitioner has been falsely implicated in this case on the basis of general and omnibus allegations. On the basis of such allegations, the petitioner is in custody since 15.05.2017. The other co-accused Sanjit Rai (Devar of deceased) has already been enlarged on bail by this Court vide order dated 19.09.2017 passed in Cr Misc No 41706 of 2017. Other co-accused persons have also been released on bail and charge sheet has been submitted in the case.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in Patori Police Station Case No 177 of 2017 subject to the following conditions : (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
