Earlier petitioner's prayer for bail was rejected by a bench of this Court vide order dated 5.10.2018, passed in Cr.Mis.No. 51390/2018 (Annexure 1) with liberty to renew the prayer for bail after nine months, if there is no substantial progress in the trial within the said period. Explanation of the Additional Chief Judicial Magistrate-VII, Siwan dated 23.9.2019, called for by a bench of this Court vide order dated 13.9.2019, indicates that the case has not yet been committed and at present the same is pending for prosecution evidence.

In view of the allegation of defalcation of public money while working as a Clerk of the bank as well as the report of the trial court, prayer for bail of the petitioner is rejected with liberty to renew the prayer for bail if the charges are not framed within six months from the date of receipt of this order.
