For the Petitioner/s : Mr. Dinesh Jha For the Opposite Party/s : Mr. Shyam Kumar Singh (App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioners apprehend arrest in Sursand Police Station (PS) Case No 24 of 2015 instituted under Sections 323, 341, 435, 376/511/34 of Indian Penal Code (IPC). At the very outset, learned counsel for the petitioners draws attention of this Court towards the first information report (FIR) and submits that mention of Section 376, IPC has absolutely no foundation. He further submits that the informant and the petitioners are agnates and there has been longstanding dispute. In fact, first, from the side of the petitioners, an FIR has been lodged for the petitioners, their fathers, brothers and others grievously assaulted. It is in retaliation thereto that subsequently this FIR has been lodged.

No.17680 of 2015 (2) dt.08-06-2015 Be that as it may, in the facts and circumstances of the case, in the event of their arrest or surrender within four weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Subdivisional Judicial Magistrate, Pupri at Sitamarhi in Sursand PS Case No 24 of 2015 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
