JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Having assemblage for the purpose of committing dacoity, became known to the police officials whereupon raid was conducted and during course thereof, two managed to escape while four persons were apprehended, petitioner Md. Shakeel @ Md. Shakeeluddin happens to be one of them. It is further evident that from the possession of petitioner as well as from the possession Chandan countrymade pistol were recovered while from the possession of Sanjay as well as Satendra only cartridges were recovered. They have further disclosed identity of two associates as Bihari as well as Md. Rezwan. Motorcycle was also seized therefrom.

Petitioner happens to be under custody since 16.05.2017 and as per para-3 of the petition, petitioner lacks criminal antecedent.

Shakeeluddin is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No.251/2017.
