For the Petitioner/s : Mr. Rajiva Ranjan For the Opposite Party/s : Mr. Yogendra Kumar, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 02-07-2015 This application under Section 438 CrPC is filed with a prayer for grant of anticipatory bail to the petitioner who is an accused in relation to Udwant Nagar PS Case No. 142/2014 for the offence punishable under Sections 498A, 304B, 201/34 of the Indian Penal Code pending in the court of the Chief Judicial Magistrate, Bhojpur, Ara.

The petitioner is the father-in-law of the deceased. He figured as an accused in the aforesaid Udwant Nagar PS Case No. 142/2014, wherein offence punishable under Section 304B and other offences are alleged. Apprehending his arrest, the petitioner filed ABP No.661/2014 in the court of learned Sessions Judge, Bhojpur, Ara. The same was rejected through order dated 3.9.2014.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor.

Patna High Court Cr.Misc. No.45266 of 2014 (3) dt.02-07-2015 2/2 The allegation against the petitioner is serious in nature. It is not in dispute that the petitioner is the father-in-law of the deceased and the death had taken place on 1.4.2014. The petitioner is an accused named in the FIR. In the circumstances of the case, the question of granting anticipatory bail to the petitioner does not arise.

This application is rejected.
