2. The petitioner is in judicial custody in connection with Sessions Trial No. 56/2024 arising out of Sono P.S. Case No. 358 of 2023 for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code lodged on 06.10.2023 by the informant, Mahendra Yadav.

3. As per the prosecution story, the informant alleged that his son was married to Seema Devi but they always used to quarrel. She later also developed illicit relationship with this petitioner which was unacceptable to the informant's son and as such under conspiracy, the lady ensured that her paramour (the petitioner herein) kills her husband.

4. Earlier, the Trial Court Report was called for and

Patna High Court CR. MISC. No.55341 of 2025(3) dt.26-09-2025 2/2 vide letter no. 155 dated 25.08.2025, the same has been sent according to which, all the prosecution witnesses have been examined but later, prosecution side wanted recall of PW-1, PW-6 and as such, there has been some delay.

5. Learned APP opposes the prayer for bail submitting that allegation is direct against the petitioner.

6. Taking into account the submissions of the parties, for the present, this Court is not inclined to grant him the privilege of bail, which is accordingly rejected.

7. However, since the petitioner is in custody for long (08.10.2023), it is directed that the Trial Court expedite the trial and conclude the same by 31.12.2025.
