2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 317(4), 317(5), 318(4), 338, 336(3), 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and under sections 8(c) and 21(b) of the NDPS Act.

3. As per prosecution case, there is allegation of recovery of 6.30 grams Smack from the possession of coaccused Aman Kumar who was apprehended on the spot. Said Aman Kumar disclosed name of the petitioner as his associate who managed to flee away.

4. It is submitted on behalf of the petitioner that this petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner's name has come in this case during course of investigation on the basis of

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Principal District and Sessions Judge, Jehanabad in Arwal Police Station Case No. 123 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
