JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Phenhara P.S.Case No. 70 of 2015 registered under Sections 386 and 387/34 of the Indian penal Code.
Allegation is of making demand of extortion money of Rs. 50 lacs from a road contraction company.
Learned counsel for the petitioner submits that except disclosure of the name of the petitioner by co-accused Manoj Singh named in the FIR, there is no other material, he was not even put on T.I.P. and he has been remanded in this case from another case, petitioner is in custody since 23.02.2017. He submits that police has also submitted charge sheet against him and other similarly situated co-accused persons namely Sunny Kumar Singh and Rahul Singh have been admitted to bail by a co-ordinate
Patna High Court Cr.Misc. No.61118 of 2017 (2) dt.19-12-2017 2/2 bench of this Court vide order dated 15.07.2016 in Cr. Misc. No. 24251 of 2016 and order dated 01.05.2017 in Cr. Misc. No. 19667 of 2017 respectively.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Sudhir Singh @ Sudhirkumar Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-XII, Motihari East Champaran in connection with Phenhara P.S. Case No. 70 of 2015 with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical urgency, his bail bond shall be liable to be cancelled.
