JUSTICE RAKESH KUMAR ORAL ORDER 05-02-2016 Heard Sri Akhilesh Dutta Verma, learned counsel for the petitioner, learned AC to AAG-2, learned counsel for the Accountant General, Bihar as well as Sri Rakesh Kumar Singh, learned counsel , who has appeared on behalf of Respondent nos. 4 and 5/ State Bank of India.
The petitioner has approached this Court with a prayer to direct the Respondents to pay and release the pension amount and also for payment of pension amount in the account of the petitioner every month.
At the very outset, learned counsel for the Respondent/ State Bank of India submits that he has received instruction that as
Patna High Court CWJC No.19727 of 2014 (2) dt.05-02-2016 2/2 per authorization, the pension amount has already been credited to the account of the petitioner and the petitioner is regularly getting pension. This submission was not disputed by learned counsel for the petitioner, but now he raised claim for payment of interest. Keeping in view the fact that some procedural delay has occurred in crediting the amount in the account of the petitioner, it would be difficult for this Court to pass any order in respect of oral claim of interest. Since as per authorization, pension amount has already been credited to the account of the petitioner and the petitioner is regularly getting pension amount, there is no need to keep the matter pending.
The writ petition stands disposed of.
