JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-11-2022 The present petition has been filed seeking the following relief :- "(i) For issuance of an appropriate writ in the nature of mandamus directing and commanding the respondent authorities to remove the encroachment from the public road appertaining to Plot no. 281 in front of Raiyati land of petitioner bearing Khata no.

Patna High Court CWJC No.19763 of 2021(2) dt.07-11-2022 2/2 1129, Plot no. 233, whereby and whereunder the private respondents have made hut/ pucca house over the public road in front of the house of the petitioner it causes apprehensions and traffic hazards to the public at large of this village. The petitioner having no any road to get enter into the house."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Bathanaha, Sitamarhi for redressal of his aforesaid grievance. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Bathnaha, Sitamarhi by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
