JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case, petitioner was caught with stolen motorcycle and after that on the basis of his confessional statement, some stolen motorcycles were also recovered but submission on behalf of the petitioner is that one Suhail Alam was caught by the police with stolen motorcycle and the aforesaid co-accused Suhail Alam made his confessional statement leading to recovery of stolen motorcycle from possession of co-accused Manish Kumar. So far as petitioner is concerned, nothing was recovered from his conscious possession and he was only caught with co-accused Suhail.
Patna High Court Cr.Misc. No.3541 of 2016 (3) dt.19-02-2016 2/2 It is contended by him that to save the skin of coaccused Suhail, the police implicated the petitioner in the present crime. Moreover, petitioner is in jail custody since 4.7.2015, hence, the investigation against him has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Krishna Gopal, Judicial Magistrate 1st Class, Patna in connection with Patrakarnagar P.S.
